VIP72 – SERVICE RULES (TERMS OF USE)

These Service Rules ("Terms") govern your access to and use of services offered under the VIP72 brand ("VIP72," "we," "us," or "our"), including our VPN applications, websites, support systems, and related services (collectively, the "Service"). Please read these Terms carefully. By using the Service—whether as a "Visitor" (browsing) or "Customer" (having registered or subscribed)—you agree to be bound by these Terms. If you disagree with any part of these Terms or value your privacy, please do not use the Service.

1. OWNERSHIP AND INTELLECTUAL PROPERTY

  • • All content and materials provided via the Service, including software, interfaces, trademarks, logos, designs, documentation, and other proprietary content (collectively, "Content") are owned by or licensed to VIP72.
  • • You may download and use this Content only for your personal, non-commercial use through our Service. Do not copy, change, share, or show this Content in public without our written permission. Trying to do so may lead to legal action.

2. ACCEPTABLE USE & RESTRICTIONS

You must not, under any circumstances:

  • • Use the Service for illegal, harmful, or unethical purposes, including but not limited to copyright infringement, harassment, fraud, or violating local laws.
  • • Transmit malware, viruses, or any malicious code.
  • • Attempt to compromise the Service's security or infrastructure.
  • • Distribute spam or unsolicited communications via the Service.
  • • Engage in network abuse, such as DDoS attacks or port scanning.
  • • Violate export control, privacy, or data protection laws.

3. SECURITY

  • • Any attempt to bypass, interfere with, or circumvent our network security, data encryption, or authentication mechanisms is strictly prohibited.
  • • You agree that you will not probe, scan, or test the vulnerability of the Service without prior written permission.

4. USER PRIVACY & DATA LOGGING

  • • We may collect minimal connection metadata (e.g., timestamps, bandwidth usage, server usage) for network monitoring, service improvement, and fraud prevention.
  • • We do not log your browsing traffic, visited websites, or personal data unless explicitly stated in our Privacy Policy.

5. LIMITATION OF WARRANTIES

  • • The Service is provided "as is" and "as available", without any warranties, either express or implied. This includes warranties for a particular purpose, accuracy, or uninterrupted service.
  • • We do not guarantee the availability, speed, or reliability of the VPN connection, nor that the Service will be free of errors, latency, or interruptions.

6. LIMITATION OF LIABILITY

  • • To the maximum extent permitted by law, VIP72 and its affiliates, officers, and agents are not liable for any direct, incidental, consequential, punitive, or special damages arising from your use of the Service.
  • • Our total liability, whether based on contract or other grounds, will not be more than the fees you paid to VIP72 in the past 12 months, if any.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless VIP72 (and its officers, employees, and agents) from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your use of any materials obtained through the Service.

8. TERMINATION AND SUSPENSION

  • • We reserve the right to suspend or terminate your access immediately and without notice if you violate these Terms, engage in harmful conduct, or if provision of Service becomes legally or technically impracticable.
  • • Upon termination, your right to use the Service ceases, but all provisions relating to liability, indemnity, and confidential information survive termination.

9. THIRD_PARTY SERVICES AND CONTENT

  • • The Service may include links or connectivity to external websites or third-party services. We do not endorse, control, or assume liability for third-party content or services.
  • • Use of third-party platforms is at your own risk and subject to their respective terms.

10. CHANGE TO TERMS

We may modify these Terms at any time. The updated Terms will be posted on our website and will become effective immediately or as otherwise stated. Continued use of the Service after the changes constitutes acceptance of the new Terms.

11. GOVERNING LAW AND DISPUTE RESOLUTION

  • • Disputes must be submitted in writing via email, with sufficient detail about the claim. We will have 30 days to respond via email before any formal legal action.
  • • Class Action Waiver: Unless prohibited by law, you agree to waive your right to participate in class action lawsuits; disputes must be resolved individually.

12. SEVERABILITY, WAIVER, ENTIRE AGREEMENT

  • • If any provision is deemed invalid or unenforceable, it will be severed without affecting the enforceability of the remaining Terms.
  • • Failure to enforce any right under these Terms does not constitute a waiver of that right.
  • • These Terms, together with our Privacy Policy, constitute the entire agreement between you and VIP72 regarding your use of the Service.
